1. Acceptance of Terms

By accessing or using Ketchup ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

Ketchup is a software service that connects to your GitHub repositories and generates automated video, audio, and text recaps of your code commits and changes. The Service uses artificial intelligence to analyze your Git history and create shareable content.

3. Account Registration

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Eligibility

You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Third-Party Integrations

Our Service integrates with various third-party platforms (e.g., GitHub, Slack, Linear). By connecting these accounts, you grant Ketchup permission to:

  • Access necessary information to provide the integration features
  • Read repository metadata, commit history, and issue details
  • Send notifications or updates on your behalf (e.g., Slack messages, GitHub Releases)

We will never modify your code without your explicit action. You can revoke access to these integrations at any time through the respective platform settings or our dashboard.

5. Subscription Plans and Billing

5.1 Plans

We offer both free and paid subscription plans. Plan features and pricing are described on our pricing page and may be updated from time to time.

5.2 Billing

  • Paid subscriptions are billed in advance on a monthly or annual basis
  • All fees are in USD and non-refundable except as required by law
  • You authorize us to charge your payment method on a recurring basis
  • Failure to pay may result in service suspension or termination

5.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until that time.

5.4 Price Changes

We may change our prices at any time. For existing subscribers, price changes will take effect at the start of the next billing cycle after reasonable notice.

6. Usage Credits

Video generation is based on usage credits:

  • Credits are allocated monthly based on your plan
  • Unused credits may roll over depending on your plan
  • Additional credits can be purchased separately
  • Credits have no cash value and are non-transferable

7. Acceptable Use

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Upload malicious code or viruses
  • Attempt to gain unauthorized access to the Service
  • Use the Service to harass, abuse, or harm others
  • Generate content that is illegal, harmful, or offensive
  • Resell or redistribute the Service without permission
  • Interfere with or disrupt the Service
  • Use automated scripts to abuse the Service
  • Reverse engineer or attempt to extract source code

8. Content and Intellectual Property

8.1 Your Content

You retain all rights to your source code and repositories. By using the Service, you grant us a limited license to access and process your code to provide the Service.

8.2 Generated Content

Content generated by Ketchup (videos, audio, text) is owned by you. However:

  • Free tier content may include Ketchup watermarks
  • We may use anonymized generated content for marketing purposes
  • You are responsible for ensuring your use of generated content complies with applicable laws

8.3 Our Intellectual Property

The Service, including all software, designs, text, graphics, and other content (excluding your content), is owned by Ketchup and protected by copyright, trademark, and other intellectual property laws.

9. Privacy and Data

Your use of the Service is also governed by our Privacy Policy. We collect and process your data as described in that policy.

10. Disclaimers and Limitations

10.1 Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10.2 AI-Generated Content

Content generated by AI may contain errors or inaccuracies. You are responsible for reviewing and verifying all generated content before use.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KETCHUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify and hold harmless Ketchup from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service at any time, with or without cause or notice, for any reason including violation of these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and data
  • You remain liable for any outstanding fees
  • Sections of these Terms that should survive termination will remain in effect

13. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time. We may also update these Terms from time to time. We will provide notice of material changes through the Service or via email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law
